Reading the monthly Visa Bulletin by the U.S. Department of State (DOS) is necessary for individuals preparing to file an adjustment of status in the U.S.
In this article, you can find the adjustment of status filing dates from the current month’s Visa Bulletin.
What is an Adjustment of Status (AOS)?
Adjustment of status (AOS) refers to the process in which a nonimmigrant visa holder living inside the U.S. applies for a Green Card and adjusts their status to lawful permanent resident.
For example, if an H-1B visa holder applies for a Green Card in one of the employment-based categories, that would be referred to as an AOS application.
Why is the Visa Bulletin Important for Adjustment of Status?
AOS applicants must read the monthly Visa Bulletin to determine when they can file their application.
Applications submitted outside this window are likely to be denied or deferred.
The Visa Bulletin includes two different charts per visa preference category:
- Application Final Action Dates (dates when visas can be issued); and
- Dates for Filing Applications (earliest dates when applications can be submitted).
Once USCIS ascertains that there are immigrant visas available, applicants are instructed to use the Dates for Filing Applications chart to determine when they should begin their AOS application.
Otherwise, the Application Final Action Dates chart must be used for determining when to begin.
When to File for Adjustment of Status
Refer to the charts below to find out when you are able to file your AOS application.
Here’s how to read the charts:
- Find your visa type (i.e. F1, EB-5, etc.) in the left column/
- Look to the right in that row and find the date that corresponds with your country (in the top column of the chart).
- “Current” means that your priority date (date when the immigrant visa petition or labor certification was filed) is earlier than the date on the chart so you may begin the AOS application.
- “Unauthorized” means that there are no visa numbers available for issuance.
