Form I-751 Checklist of Supporting Documents (Remove Conditions on Residence)

Form I-751, Petition to Remove Conditions on Residence, is an immigration form filed by conditional residents who obtained their permanent residence through marriage.

Form I-751 must be filed by residents who hold a two-year green card.

Form I-751 must be filed within the 90-day period preceding the conditional green card’s expiration date.

This petition is typically filed jointly by the conditional resident and their spouse.

If the marriage ended in divorce, death, or abuse/extreme cruelty, a conditional resident can apply for a waiver of Form I-751.  This means that conditional residents request USCIS to remove conditions without their spouse. 

However, certain supporting documents must be submitted with the waiver petition (see below).

Jointly filed Form I–751 checklist of documents

If the conditional resident is filing Form I-751 petition with their spouse, submit photocopies of the following documents:

1. Most recent edition of Form I-751 (both spouses must sign and date the form)
2. Conditional green card (front and back)
3. Conditional green cards of children you are including in your petition (front and back, if applicable
4. Birth certificates of children born during the time of this marriage
5. Driver’s license / State picture I.D for both spouses that show the joint residential address
6. Jointly filed tax returns
7. Joint lease agreement with both names on it. Both spouses must sign the lease
8. Joint utility bills with both names on it
9. Joint mortgage documentation with both spouses names on it
10. Joint bank account statements
11. Joint credit card statements
12. Joint savings, certificate of deposit (CD), investment account statements
13. Joint health insurance
14. Joint life insurance
15. Joint car insurance
16. Joint renter’s insurance
17. Joint house insurance
18. Annotated wedding photographs, wedding invitations, etc.
19. Annotated family photographs (include dates, names, location, etc.)
20. Employment records showing the spouse listed as emergency contacy
21. Evidence of correspondences between the spouses (text messages, phone calls, video calls, etc.)
22. Joint vacation documentation (airline tickets, hotel reservations, receipts for joint expenses, etc.)
23. Gifts receipts
24. Notarized witness affidavits from individuals who have personal knowledge of the relationship
25. If you have ever been charged with a crime or arrested – copies of the police arrest records and certified court disposition for the charge or arrest
26. If either spouse is an active member of the U.S. military:
    1. Military spouse ID (front and back)
    2. Military health insurance documentation
    3. Life insurance listing the spouse as beneficiary
    4. Permanent Change of Station (PCS) orders issued that name the spouse

Form I-751 divorce checklist

If conditional resident has divorced their spouse and filing for Form I-751 waiver of joint filing, submit photocopies of the following documents:

1. Most recent edition of Form I-751 (conditional resident must sign and date the form)
2. Conditional green card (front and back)
3. Final divorce decree (judgment);
4. Statement by the conditional resident outlining the history of marital relationship and reasons that lead to the divorce
5. Joint residential lease with both spouses names on. Both spouses must sign it
6. Joint mortgage documentation with both spouses names on it
7. Both spouses’ driver’s licenses or state IDs showing their shared residential address;
8. Jointly filed federal tax returns
9. Joint car insurance documentation
10. Joint bank account statements
11. Birth certificates of children born during the time of this marriage
12. Joint credit card statements
13. Joint savings, certificate of deposit (CD), investment account statements
14. Joint health insurance
15. Joint life insurance
16. Joint renter’s insurance
17. Joint house insurance
18. Annotated wedding photographs, wedding invitations, etc
19. Annotated family photographs (include dates, names, location, etc.)
20. Employment records showing the spouse listed as emergency contact
21. Evidence of correspondences between the spouses (text messages, phone calls, video calls, etc.)
22. Joint vacation documentation (airline tickets, hotel reservations, receipts for joint expenses, etc.)

24. Wedding expenses (banquet hall contract, photographer contract, catering contract, receipts for all wedding expenses)
25. Notarized witness affidavits from individuals who have personal knowledge of the relationship
26. If you have ever been charged with a crime or arrested – copies of the police arrest records and certified court disposition for the charge or arrest
27. If either spouse is an active member of the U.S. military:
    1. Military spouse ID (front and back)
    2. Military health insurance documentation
    3. Life insurance listing the spouse as beneficiary
    4. Permanent Change of Station (PCS) orders issued that name the spouse

Form I-751 Extreme Cruelty/Abuse checklist

If conditional resident is applying for a waiver of joint Form I-751 filing due to extreme cruelty/abuse, submit photocopies of the following documents:

1. Most recent edition of Form I-751 (conditional resident must sign and date the form)
2. Conditional green card (front and back)
3. Divorce decree (if the marriage has been terminated divorce and was terminated on grounds of physical abuse or extreme cruelty)
4. Police reports
5. Official court record
6. Medical records
7. Records issued by school officials, clergy, social workers, and other social service agencies
8. Order(s) of protection against the abusive spouse
9. Evidence that conditional resident applied for shelter(s) for domestic violence victims
10. Photographs of injuries
11. Notarized affidavits from witnesses of abuse
12. Evidence of bona fide marriage:
    1. Joint lease agreement(s)
    2. Joint utility bills
    3. Birth certificate(s) of child(ren) born during the marriage
    4. Joint bank account statements
    5. Joint credit card statements
    6. Joint health insurance
    7. Joint car insurance
    8. Annotated personal photographs (include dates, names, location, etc.)
    9. Wedding photographs
    10. Wedding expenses
    11. Any other evidence of marriage

Form I-751 death of spouse checklist

If conditional resident is applying for a waiver of Form I-751 joint filing based on spouse’s death, submit photocopies of the following documents:

1. Most recent edition of Form I-751 (conditional resident must sign and date the form)
2. Conditional green card (front and back)
3. Death certificate
4. Evidence of bona fide marriage:
   1. Joint lease agreement(s)
   2. Joint utility bills
   3. Birth certificate(s) of child(ren) born during the marriage
   4. Joint bank account statements
   5. Joint credit card statements
   6. Joint health insurance
   7. Joint car insurance
   8. Annotated personal photographs (include dates, names, location, etc.)
   9. Wedding photographs
   10. Wedding expenses
   11. Any other evidence of marriage

Form I-751 terminated status and removal proceedings checklist

If conditional resident’s status was terminated and removal will cause “extreme hardship”, submit photocopies of the following documents:

1. Evidence of medical problems that developed after entering the US that requires care and treatment in the U.S.:
   1. Medical records from US doctors
   2. Information about diagnosis, treatment, and availability of treatment in conditional resident’s home country 
   3. Objective information about the health care system in a conditional resident’s home country (reports, articles, etc.)
2. Evidence of adverse political, social, or economic conditions that have developed recently in the conditional resident’s country:
   1. US Department of State official human rights reports
   2. Articles
   3. Reports of country experts

Where to mail Form I-751 application

A signed and dated Form I-751 form, correct filing fee, and photocopies of the supporting documents must be sent by mail to USCIS:
