What is a labor consultation?

  • A labor consultation refers to the process where a U.S. employer is seeking to sponsor a foreign worker for certain visas (O and P)
  • A U.S. employer must obtain a consultation letter from an appropriate labor organization and submit it with Form I-129 application
  • Labor consultations can discuss the following issues:
    • Nature of the work to be done in the U.S.
    • Beneficiary’s qualifications to complete the work
    • Sometimes labor organizations might object on grounds of low wages or the availability of U.S. workers 
  • If a labor organization does not exist, a consultation letter is not required

Which applications require a labor consultation?

The following nonimmigrant visa petitions require submission of a labor consultation:

  • O visa category is designated for individuals with extraordinary ability or achievement in specific fields such as science, education, business, athletics, or the arts. There are three types of O visas:
    • O-1A Visa: For individuals with extraordinary ability in the fields of science, education, business, or athletics
    • O-1B Visa: For individuals with extraordinary ability in the arts or extraordinary achievement in the motion picture or television industry
    • O-2 Visa: For individuals who will accompany an O-1 visa holder to assist in a specific event or performance
  • P visa category is designed for athletes, artists, entertainers, and their support personnel who wish to come to the U.S. temporarily to perform, compete, or participate in a culturally unique program. There are several types of P visas:
    • P-1A Visa: For internationally recognized athletes or members of an internationally recognized athletic team.
    • P-1B Visa: For internationally recognized entertainers or members of an internationally recognized entertainment group.
    • P-2 Visa: For artists or entertainers who will perform under a reciprocal exchange program between an organization in the U.S. and an organization in another country.
    • P-3 Visa: For artists or entertainers who will perform, teach, or coach in a culturally unique program in the U.S.
